Our motion for summary judgment was granted for the defendants in Johnson v. Brown / Deaver (Polk County, LACL 148455), a case where the plaintiff brought three claims pertaining to a house sale. One claim was for an intentional tort, which "are generally poor candidates for summary judgment" dismissal.
Even so, the Polk County District Court dismissed all three claims on July 6, 2022, and the case itself.
Good news on June 15th from the Iowa Court of Appeals, which reversed an adverse district court opinion against my clients--Michael and Diane McKee. The McKees' property is being damaged from the City of Council Bluffs' stormwater drainage. The case presents "a twist" from typical drainage cases, but it's sure nice to finally see a straightforward analysis in favor of people that deserve it. (I wrote all the briefs at my old firm but argued the case at Capitol Counsel.)
